According to police, Marcus Weldon was dressed as Santa Claus when he got into an argument in December with a man at the Speedway in the 700 block of Jefferson. The fight escalated, police say, and Weldon pulled a gun and fired several shots at the the man and a passenger in his car.
Weldon left the gas station but was arrested a short time later.
Both men were taken to the hospital. One victim, Salah Rifai, has been released, while the other remains hospitalized.
Rifai attended court Thursday and testified.
FOX 2's Erika Erickson is in the courtroom and reports Rifai testified he was shot in the hand, and that "one of the bullets ripped my arm off the steering wheel."
Weldon's family says he acted in self defense. They say he was helping his coworker change her tire after leaving a holiday party, hence the santa suit, when she was attacked by strangers.
Weldon is licensed to carry a concealed weapon.
