M.L. Elrick has been working on this story since it broke and has an exclusive report on that 911 call.
Smith's ex-wife Anistia Smith had just been allegedly assaulted after an altercation. She had just fled from the house after Smith allegedly shot at her call.
There were two 911 calls made May 10 after the incident which FOX 2 filed Freedom of Information Acts to gather. The request for the first call was granted.
The recording transcript is as follows, after Smith gives her location to the operator.
Operator: "Single family home or apartment?"
Anistia Smith: "It's a family home."
Operator: "What's going on there?"
Smith: "My ex-husband just shot up my car."
Operator: "Is he still there?"
Smith: "Yes, he's walking down the street towards me now."
Operator: What's his name?
Smith: "Sen. Virgil Smith."
Operator: "Okay give me your description of him."
Smith: "Light skin ... he's a senator. I want him ..."
Operator: "How old is he?"
Smith: "He's 35."
Operator: "Give me a call back number."
FOX 2 does not know why the call ends there, whether it has been edited to keep the phone number private or if that's where the ex-wife of Sen. Smith hung up on 911.
The second call will not be released because police reports say it was made from a neighbor's house after Anistia Smith sought shelter there. The city says it is part of an ongoing investigation and on it you can hear the home owner's address and her voice and they would like to keep that private.
Smith has been charged with felonious assault, domestic violence, malicious destruction of personal property of $20,000 or more and possessing a firearm during commission of a felony.
