- A man who should not have been behind the wheel for the last 26 years is sitting in jail this week and now facing second degree murder charges after a 12-year-old girl died when his vehicle rear-ended the family's van last week.

Last Wednesday, authorities say Cahill was three times the legal limit when he got into his car. The Sumpter Township man was headed north on Martinsville Road near Willis Road at a high rate of speed when he rear-ended the family's minivan.

There were five people inside the car including Victoria and two other young children. The 12-year-old girl was in the third row.

As Cahill's car came flying down the road, it crashed into the back of the family van. Victoria had to be cut from the vehicle and was flown to Mott Children's Hospital. She was on life support until Saturday when she died from her injuries.

Victoria's family said they donated the young girl's organs.

Officials said Cahill's BAC was more than three times the legal limit.

On Monday, the Wayne County prosecutor's office filed charges of second-degree murder; operating with high BAC causing death; operating with a suspended license causing death.

So why was this man still on the road? That's the question that Amy Lange will attempt to air tonight on FOX 2 news at 6.

Cahill's next court appearance is set for August 10.
