Accuser faces 14-year-old rape suspect in Warren Lincoln attack

Tragic testimony from a 15-year-old girl who reluctantly described a brutal attack and rape inside of her school. 

The young girl faced her alleged rapist Khymani Tolbert in court Thursday and when asked what happened, she said she did not want to talk about it.

"I gave up because what else could I do," she said. "He was already doing what he was going to do."

On Nov. 28, in an empty stairwell at Warren Lincoln High School, Tolbert, 14, started groping the then-14-year-old freshman. Then he started putting his hands down her pants.

"He started touching me and I didn't like that," she said. "He slammed me onto the floor ... like how they do it in football."

When she resisted she says he got more aggressive. It went on for 25 minutes, security cameras capturing it all. 

Tolbert is being charged as an adult facing three counts of criminal sexual conduct and unlawful imprisonment. The judge said that he found enough evidence to bound the case over to circuit court.

Tolbert's defense attorney working to prove some kind of consent from the young girl.

"Don't you remember touching his groin?" said the attorney.

"I never touched him," she said.

Defense pressed on saying the two had been talking throughout the day and the conversation became explicit. But, the teen says she never wanted anything from Tolbert.

Her attorney said: "Did you consent to sex with Khymani when he was pulling down your pants and you were trying to keep them up?"

"No," she said.

"Were you consenting to sex when you were lying face down and he was on top of you from behind?"

"No," she said.

Tolbert was not given a bond and will stay behind bars until the trial.
