Driver in crash that killed two kids given probation

Nearly two years after a tragic car accident killed two kids, the reckless driver who crashed the car learns he won't spend a day in jail.

Gladys Shaw says the man, who was accused at first of driving drunk killed her grandson and his own son in the crash,  basically got a slap on the wrist.

"It is very hard," Shaw said. "Every day I have to go through grief thinking about it."

There is not a day that goes by, Shaw doesn't think about her 16 year-old grandson Jalen Jemison.

He was killed two years ago when his mother's boyfriend 34-year-old Mlinzi McMillian, was speeding off I-75 and struck a semi-truck near Oakland and Holbrook in Detroit.

Mlinzi's 12-year-old son, who was also in the car and died.

"They say he had 165-feet of skid marks so you figure that out," Shaw said. "That is real fast, isn’t it? He couldn’t stop. When that truck turned, he had the right-away and he couldn't turn."

Court records show Mlinzi, a habitual offender, was initially charged with two counts of driving under the influence causing death and reckless driving causing death.

But Shaw learned Mlinzi has accepted a plea. He will only receive 5 years probation and won't spend a day in jail. He didn't even lose his driver's license.

"I don't think it's fair at all and two kids are dead," Shaw said. "That's not justice."

FOX 2 was unable to get ahold of Mlinzi, but were able to speak to his attorney William Sharp by phone.

He says the charges against Mlinzi for driving under the influence causing death were thrown out, because blood alcohol results were inconclusive and the prosecution couldn't prove it.

They were able to make this probation deal, because the mother of both of the deceased children support it.

But that hasn't stopped this grandmother. Shaw has started a petition on Change.org. It is called Justice for Jalen.

She wants a stronger sentence for the man, who is responsible for taking the life of her dear grandson.

I just want justice for Jalen, I don't want anyone else to go through what I've gone through," Shaw said. "Two kids' lives are gone, for no reason."

Mlinzi will be sentenced on April 13th.
