The family of a 15-year-old special needs girl said she was sexually assaulted in a school bathroom.

The classmate who committed the heinous crime allegedly recorded it on his cell phone and then shared it with others, including the victim.

The mom of the teen, who we are not identifying, is already fighting cancer. Now, she's going to battle with the school district. She says after her teenage daughter was assaulted, the 15-year-old was kicked out of the district.

"How could this happen? It's unbelievable to me," her mom said. "I just wanted my child safe and to be in school."

The girl had just enrolled at SRAC, Southfield's alternative high school. She was living with her aunt who said she was understandably stunned by what she learned at the end of September.

"Horror and shock that this had happened to her. Horror and shock that he had distributed this to God knows how many people," her aunt said.

She said a boy told her niece to board a bus at Southfield High and meet him in one of the boys' bathrooms. That was September 28th. The next day, the 15-year-old received text messages showing the sexual encounter. They said the teen also shared the photos and videos with friends.

"She says no you don't understand he videotaped it and he sent it to the other students and now they're all sending me screen shots," her mom said. "I said let me see it and she showed it to me."

The family says the teenage girl was suspended for skipping school and then told her she had been dis-enrolled and was not welcome back.

Her mom is desperate to get her child back in school and says she's being denied her education.

"This is a young lady who needs help. She wants to be in school. They need to take her back and put her in school and help her heal not only from the harm inflicted on their watch but the harm they've inflicted on her now," attorney David Christensen said.

FOX 2 contacted the school who released this statement:

"The allegations are currently under investigation by the Southfield Police Department. At this time, Southfield Public Schools' has no evidence of a sexual assault, nor any evidence that a video was distributed.  We value our students education and will enroll all students who can provide accurate enrollment information."
