Victims of cancer doc in court as judge decides on dispersing his $12M estate

He's the cancer doctor turned criminal while Fareed Fata sits behind bars, his victims are still waiting for their share of his estate.

Today, many of those victims appeared in court hoping to hear the judge's ruling.

But what about compensating victims?  Federal Judge Paul Borman has to determine how the 553 victims, and there may be more, split up the $12 million the government was able to seize from Dr. Fata's assets.

"There's not a penny that would bring back my husband, not a penny," said Patricia Loewen.

Dr. Farid Fata, the former oncologist apologized when he pled guilty to giving cancer treatment to those that didn't need it, back in July of last year. 

FOX 2: "Forty-five years in prison for Dr. Fata."

"Not enough," said Loewen.

"By me having a liver transplant as a result of the unnecessary chemo, I am still under treatment right now," said Teddy Howard.

And to figure it out, the judge appointed a facilitator that the government will pay for, who will develop a form for victims to document any out-of-pocket expenses or monies it took to fix what Dr. Fata had done. 

FOX 2: "There is nothing in the settlement for pain and suffering you went through."

"There is no money for that," said Loewen.

And of the $12 million seized for victims, the law allows the whistleblower to get 10 percent of that money, off the top.

"Everyone thinks we are all going to be rolling in dough," said Loewen. "There is no money for the people who have died."

Fata did not show up in court Thursday in fact the judge said that Fata waived his right to show up in court. The only issue now is whatever money Fata had, give it to the victims.

But those victims will have to wait until at least May before the claim form is ready. And there could be claims from Blue Cross, Medicaid and Medicare who paid millions to Dr. Fata.
