Questions surround weapon used in Sen. Smith shooting

Detroit police carried a rifle wrapped in a garbage bag at the scene of an alleged shooting involving Sen. Virgil Smith.

Now some are questioning if it was the right rifle used in the incident where his ex-wife's car was shot up.

He's been MIA in Lansing and Sen. Virgil Smith hasn't been seen until now.

FOX 2 showed up at his house on Wexford - the scene of the crime and when he saw us, he ran into a neighbor's house.

According to police reports, State Sen. Virgil Smith basically confessed, saying shooting into his ex wife's car was the stupidest thing he's ever done in his life. But police aren't sure he came clean about everything.

Questions now surround the weapon used the night. Police say he got into a fight with his ex-wife Anastia Thomas and fired as she ran away.

Despite some reports - Smith wasn't that cooperative that night. When police came knocking at his Wexford Street house he didn't answer  Until the next day when he hired a lawyer.

When police searched his home, FOX 2 learned they retrieved a MAS 49/56 - A French vintage semi-automatic rifle, similar to what's being carried out in a garbage bag. Officers found it in the back bedroom closet  with around 75 rounds.

But sources tell FOX 2 investigators are trying to figure out if that gun now in evidence, was the same one used to shoot up the ex's 2015 Mercedes.

"At this point I can't tell you if that's the gun or we are still looking for the other gun," said Chief James Craig. "It may be another gun we are looking for still early investigation."

Reports say multiple rounds were fired that night, the front of the Mercedes shot up, the windshield, the seat, four bullets embedded in the engine block.

Michigan State Police are analyzing those bullets as we speak.

In the meantime - investigators still want to know what happened to the bullet casings that night.

Only one shell was found on the sidewalk.

There have been questions if someone hid the evidence and could this vintage semi-automatic rifle do that kind of damage? Or does it take a different high-powered weapon.

If so what happened to that gun.

"We are doing our testing on it," Craig said. "We are moving it forward

Smith is facing multiple charges - from felonious and domestic violence assault to malicious destruction of property..

He's expected back in court at the end of the month.
