Sentence next for Michigan man in road rage killing

HOWELL, Mich. (AP) -- A 69-year-old man who insists he shot another driver in self-defense is returning to court for his sentence for second-degree murder.

Martin Zale's court hearing in Livingston County was delayed a week until Friday after he picked a new attorney.

Derek Flemming was shot when he confronted Zale about aggressive driving near Howell last September. Zale told jurors that he felt threatened as he sat in his pickup truck at a traffic light.

The prosecutor said Zale should have kept the window up or driven away.

A jury in May rejected first-degree murder but convicted Zale of second-degree murder, which can carry a chance at parole.
