FOX 2 - Wilfredo Figueroa-Berrios was in court Thursday on charges of sexual assault in three different instances.

The backstory:
The 47-year-old is facing criminal sexual conduct charges for allegedly sexually assaulting two of his patients in August. Both cases were bound over with a third case yet to be heard that had been scheduled for today.
The Wayne man allegedly assaulted two of the victims after they visited the hospital for treatment.
In the first case, Figueroa-Berrios is accused of sexually touching a victim who was intoxicated and was at the hospital for treatment,
She was four times the legal limit and at the Sinai Grace Crisis Center after having a mental breakdown. She said she was drinking heavily, taking pills and said she was contemplating suicide.
She was taken to the hospital where Figueroa-Berrios who she identified in court, allegedly then came into contact with her but used the name "Nurse David" before touching her inappropriately.
"He stood next to me, asked how tall I was," she said. "And said ‘Can I check something?’ So he slid his hand in the back of my pants and touched my vagina."
She claimed he smelled his fingers and said "smells good."
The woman said she was caught off guard and stunned - "I didn't know what to do."
A second time he went in the room and pressed his penis against her leg, she said.
The woman later said that "three different" social workers from the hospital dealt with her, but did not help her. She eventually checked herself out due being disturbed by the incident.
She eventually contacted Channel 7, who directed her to talk to police.
The defense attorney Deborah Schlussel, attacked the woman's credibility due to her being drunk.
Admittedly the woman said she had trouble remembering if she had her blood drawn.
"Your client knew she was drinking, so it made her more vulnerable," the judge said. "Perhaps she doesn't remember getting an IV. But you remember being sexually assaulted."
In the second case a victim who was six times the legal limit for being drunk, had passed out at a Dollar General.
An EMS was called, which took her to Sinai-Grace where she said that Figueroa-Berrios came into contact with her.
The second victim said that he made her hand touch his penis and he grabbed her breast.
"He just kept saying my last name, like, over and over again. And then also like that first time it was like, 'You pretty sexy,'" she said.
The next three times he came into her room while she was in bed, she claims the abuse escalated.
"His penis went inside of, my mouth," she said. "He comes back in the room 3 to 4 times. Like I said, it's like a little,, is somewhat, like, slightly fuzzy, but he comes in and then after maybe, like, the third or fourth time, he stops."
The second nurse she told assured her it wasn't right and got security.
The second victim said after she was released from the hospital, she felt shame and guilt.
I didn't know how to process it, I felt maybe because I was intoxicated it was my fault," she said. "I'm still trying to process that it was in a hospital. I was in a room with no door, no curtain. If I was in my right mind that never would have happened."
Schlussel questioned her memory due to the amount of alcohol she had drank. The defense also asked about a civil lawsuit and if she was involved with it against her client.
The judge clashed with the defense and insisted that the victim was intoxicated didn't hurt her credibility - but rather made her a target.
"She didn't fall asleep. She passed out at a Dollar General, which makes her vulnerable, which your client has preyed upon, that vulnerable ability, which is disgusting. Absolutely disgusting.
In this case, the judge bound over Figueroa-Berrios on criminal sexual conduct third, fourth and fifth degree.

Figueroa-Berrios is due in court next on Oct. 30.

One different victim has come forward and gone public - Trejah Shines. She went to the hospital on July 25, 2025 where Figueroa-Berrios performed an unnecessary Pap smear. He then allegedly sedated her before Figueroa-Berrios assaulted her for an hour.
Shines reported the assault to police the following day and is cooperating with police. Holland said they are waiting to file a lawsuit for a second victim who was allegedly assaulted before Shines was.
Figueroa-Berrios was previously charged after he allegedly forced himself on a victim in a porta-john in Detroit in May.
It is alleged he was arrested in 2019 for assault, faced sexual assault accusations while working at a Livonia medical facility in 2020 and 2021, and has allegedly been fired from jobs for improper conduct.
