Mom of girl killed by falling lunch table fights for Lilliana's law

A  family is remembering their 3-year-old daughter who died at a Head Start program.

Her mother, Tabatha Kerr is on a mission to keep other families from grieving the loss of a child. Two years ago her daughter Liliana Kerr was playing ball in her Dearborn Heights preschool when a fold up table broke loose and fell on top of her, killing the toddler.

It is an accident her mother says could have been prevented.

"She should be here, I should have a snow day with my kids," Kerr said.

Family and friends placed stuffed animals, flowers and balloons on Liliana's grave to remember the energetic, happy, smart little girl. 

But also they continue to protect kids with the passing of Lilliana's law. It would make school accountable for out dated and dangerous equipment.

"Right now we are finding someone to sponsor the bill so we could move forward," said Kerr. "Right now we are doing petitions, I'm still going door to door."

Tabatha isn't giving up. Just last month another child was injured by a falling table inside a Canton elementary school.

"It was a slap in the face, it was insulting, it adds more fuel to the fire for me," she said.

Kerr has filed a $10 million lawsuit against the Archdiocese of Detroit and the Wayne Metropolitan Community Action Agency, which operated the Head Start program her child was attending at the time of her untimely death.

In the meantime, she hopes other schools will proper; inspect and maintain their tables and equipment so this doesn't happen to any other child.

"I still have to send my kids to school," Kerr said. "That's hard."
