Judge to rule on Sen. Virgil Smith plea deal Monday

State Sen. Virgil Smith will go before a Wayne County Circuit Court judge on Monday to find out whether his plea deal has been accepted.

If Judge Lawrence Talon accepts his deal, Smith would resign from the state Senate. He would also be sentenced to 10 months in jail and undergo alcohol counseling. The three charges he is facing -- assault, domestic violence and using a firearm -- would be dropped.

Smith pleaded guilty to firing more than 20 rounds at his ex-wife’s car last May outside his Detroit home after she caught him in bed with another woman.

The court appointment is set for 2 p.m. Monday.
